Many businesses that are not in the content creative industries, e.g., movies, music, books, videogames and software, discount the importance of understanding what a copyright is. But most businesses have more copyrighted works than any other type of intellectual property. For example, logos, product design, product packaging, advertising and promotional materials, product catalogues, and websites, as well as software, are all types of business assets that may be protected by copyright. This module will help you learn about what a copyright is, what copyright protects, and how copyright differs from a patent or a trademark, including how a company’s logo may be protected by copyright as well as trademark, and copyright ownership, including joint ownership. While registration is not required, federal registration provides significant advantages for commercially valuable works including the entry of the facts of their copyright into the public record and the eligibility for statutory damages and attorney’s fees in successful litigation. Registration is fast, cheap and relatively easy, and you will learn about how to register a copyrighted work and the advisability of using a copyright notice. A brief discussion of copyright protection for software will be included, as well as a discussion of the differences between copyright protection and patent protection for software. This module also will provide a description of how copyrights are protected in other countries (most countries are members of one or more multi-national treaties) as well as resources provided by the U.S. Copyright Office (www.copyright.gov) and other resources.
